Maraestay NZ Terms and Conditions

Use of the Maraestay NZ platform

No other use of the Maraestay NZ platform is permitted unless authorized in writing by the Managing Director Maraestay NZ. Any other use of the MSNZ platform is deemed to be unlawful (either implicitly or otherwise) and will result in Maraestay NZ deregistering your Marae or pursuing legal action if the act is deemed necessary by the company to protect the interests of Maraestay NZ. These interests include those of its registered Marae and customers - past present and future.

By registering as a Marae or user of Maraestay NZ and using the services on offer, you acknowledge and agree to adhere to these terms. If you do not accept the terms and conditions, you will not be able to use or access the services on offer.

No advice of information that is obtained by you from us or anyone else shall be deemed to create any warranty by us that is not expressly stated in these terms and conditions. We reserve the right to make changes and amendments to the platform maraestay.co.nz, the services available and the terms and conditions at any time. These published terms and conditions at the time of reading replace any previous versions of published terms related to the use of the website.

Under no circumstances can the maraestay.co.nz platform be used in a non-advantageous way to Maraestay NZ. MSNZ will have full and exclusive rights to decide if the platform has been misused and will act according to the discretion of the Company Directors. This can (but is not restricted too) lead to the removal of the Registered Marae from the MSNZ platform. The MSNZ platform must only be used by Registered Marae to view, book and manage bookings and their Marae profile. It shall not be used for personal business or for other intentions.

All material and content uploaded to maraestay.co.nz becomes the property of the company MSNZ. MSNZ has the overall right to remove and edit unsatisfactory content without seeking permission from the Registered Marae.

Definitions

In these terms and conditions the following terms are used and refer to:

  • Maraestay NZ refers to www.maraestay.co.nz and Maraestay NZ Ltd “MSNZ” refers to MaraeStay NZ.
  • Marae: A communal and sacred meeting ground which provides everything from eating, sleeping, religious and educational facilities. A Māori community's hub, where Māori retain their tribal history and stories, genealogy, customs and traditions. Marae are available as meeting places for whanau (or visitors not affiliated to the Marae) and can be made available for overnight accommodation or day visits. Day visits can include meetings; conferences; family gatherings or wananga
  • Marae Administrators - (MAs) refers to the authorised administrators of the registered Marae profiles. They oversee and are responsible for the management of the Marae profile and the completion of their MSNZ customer bookings.
  • "Customer" refers to anyone registered to make a booking on the maraestay.co.nz. portal to a Registered MSNZ Marae.
  • Services means single or multiple services available on offer by Maraestay NZ.
  • "We", "us", and "our" refers to Maraestay NZ.
  • "You" or "your" refers to you.

Bookings

A booking refers to a Customer booking and paying to stay or visit the Marae on a certain day(s) using the Maraestay NZ platform. A booking is confirmed when the Customer receives an email or an SMS from the Marae Administrator to confirm the booking.

Cancellations and refunds

Immediate cancellation: force majeure

Bookings can be cancelled immediately in the event of a force majeure (unforeseeable; external and unavoidable) catastrophe. Events such as earthquakes, floods and fire (where significant damage is caused to the Marae) are all deemed to be force de majeure events and no liability is considered to be held on the part of the Marae when a booking is cancelled due to a force majeure. Full refunds are made to the customer in the event of a cancellation due to force majeure.

Within 30 days

A booking can be cancelled within 30 days of the completion of the booking and a full refund is paid to the customer if the following arrangements can not be confirmed:

  • the booking cannot be relocated to another Marae or
  • the customer chooses not to proceed with the alternative Marae arrangements

Tangihanga cancellation policy

Marae can only cancel a booking within 12 hours of the booking start time and date to accommodate a tangihanga (funeral). The cancellation to the customer is deemed to be effective 12hrs from notification by the Host Marae Administrator. Marae Administrators must email and SMS the customer and if possible, call the customer to advise of the cancellation. An email must be sent by the Marae Administrators to admin@maraestay.co.nz advising of the cancellation. If possible, Marae should attempt to relocate the booking to an alternative Marae to keep goodwill with their MSNZ customers and their MSNZ business. A notification that Marae have a Tangihanga cancellation policy MUST be included in the Marae Registration Forms.

Refunds

Refunds to the customer will be paid within 21 days of MSNZ receiving notification of the cancellation of the booking from the Marae Administrators.

Intellectual property

All intellectual property rights (including copyright and trademark rights) in the contents of this website and all works relating to the goods and services that we provide, including all training materials, are at all times the sole property of us (Maraestay NZ) or our suppliers or linked third parties.

You may not copy, distribute, reproduce, display or publish any, or any part of any, content of this website or any work relating to any goods or services, or any trademark that appears on this website, for any purpose whatsoever without our prior written approval. You agree to indemnify us against any claims, costs, damages or losses incurred by us should you fail to comply with this clause.

You agree that, unless we have agreed otherwise in writing, you are purchasing any goods for your own use and will not resell any goods without our prior written consent. You agree that you will only use the training materials for your own training purposes, and not for any other purpose.

Confidentiality

MSNZ will keep all information received from Marae in a safe and secure location. MSNZ will not share any information to any third parties excluding the developer Canary Data Solutions for profile activation purposes only. All data entered will be stored through the developers remote data system. MSNZ will not be held liable for other registered users who intentionally compare or copy any other profiles e.g. costing, tourism experiences, range of offerings of Marae for their profile. It is the responsibility of the Marae Administrators to ensure that all passwords and logins are kept private and frequently changed. MSNZ does not hold any responsibility for a breach of profile access outside of the “normal” possible security breaches related directly between the maraestay.co.nz platform and an external breach.
